Terms of Service

Please read these terms and conditions carefully before using our services. Your use of MaxReseller services implies acceptance of these terms.

General Terms

MaxReseller provides web hosting to clients worldwide, and we have a responsibility to protect each client and to provide the best services available. All clients of MaxReseller are subject to the following terms of service:

Paypal Payment Policy

As per our Refund policy we offer 7 Days money back only if purchased for 1 year or more. If the payment made with Paypal and If any Dispute Open for Payments which is not eligible for Refund We are not responsible for it. Its your Responsibility to Read all our policy pages before purchasing the service's.

Acceptable Usage Policy

Section A: Prohibited Material

Examples of unacceptable material include: IRC Bots, Proxy Scripts, Anonymizers, Pirated Software, Warez, image hosting only sites that do not host an actual domain/normal website content, Escrow, High-Yield Interest Programs(HYIP), Bank Debentures, Livechat/Chat Scripts, Download sites(Pirated softwares), Bank Debenture Trading Programs, and Prime Banks Programs, lottery sites, muds, rpg's, hate sites, hacker focused sites/archives/programs, sites promoting illegal activities, Flash Games or Online Gaming Sites, Movie's, MP3 Songs, File hosting. No refunds will be given.

Section B: Right to Refuse Service

We reserve the right to refuse service to anyone. Any material that in our judgment that is obscene or threatening is prohibited and will be removed from our servers with or without notice. Failure to respond to email from our abuse department within 48 hours may result in the suspension or termination of your services. If in doubt regarding the acceptability of your site or service, please contact us and we will be happy to assist you. No refunds will be given.

Section C: Child Protection

Potential harm to minors is strictly forbidden, including but not limited to child pornography or content perceived to be child pornography: Any site found to host child pornography or linking to child pornography will be suspended immediately without notice. No refunds will be given.

Section D & E: Account Actions

Resellers: we will suspend the site in question and will notify you so you may terminate the account. We will further charge you Rs.5000.00 cleanup fee if applicable. Direct customers: Your services will be terminated with or without notice. No refunds will be given.

Section F: Security Responsibility

It is your responsibility to ensure that scripts/programs installed under your account are secure and permissions of directories are set properly, regardless of the installation method. When at all possible, set permissions on most directories to 755 or as restrictive as possible. Users are ultimately responsible for all actions taken under their account. This includes the compromise of credentials such as username and password. Use a secure password.

Zero Tolerance Spam

We take a zero tolerance stance against sending of unsolicited e-mail, bulk emailing, and spam. "Safe lists", purchased lists, and selling of lists will be treated as spam. Any user who sends out spam will have their account terminated with or without notice. No refunds will be given.

Payment Information

You agree to supply appropriate payment for the services received from MaxReseller, in advance of the time period during which such services are provided. Services will be billed on a recurring basis unless notified otherwise. MaxReseller reserves the right to change rates at anytime.

Backups and Data Loss

Your use of this service is at your sole risk. Our backup service is provided to you as a courtesy. MaxReseller is not responsible for files and/or data residing on your account. You agree to take full responsibility for files and data transferred and to maintain all appropriate backup.

Cancellations & Refunds

MaxReseller reserves the right to cancel or restrict access at any time. We offer an unconditional 7 day money back guarantee on managed shared hosting and reseller solutions for first invoices paid via credit card or Paypal. Refund requests after 7 days will not be entertained.

Resource & Bandwidth Usage

Usage Restrictions

  • Use 25% or more system resources for > 90s
  • Run stand-alone server-side processes
  • Run web spiders or indexers
  • Bit torrent applications or trackers
  • File-sharing/peer-to-peer activities
  • Gaming servers (CS, Half-Life, etc)

Bandwidth Policy

Accounts passing allocated bandwidth may be suspended until the next month, or until more bandwidth is purchased. Unused transfer cannot be carried over.

Uptime Guarantee

Shared/reseller servers have a 99.9% uptime guarantee. Physical downtime outside this may result in one month of credit, subject to justification and approval. Does not apply to VPS or Dedicated servers.

Reseller Responsibility

Resellers are responsible for supporting their clients. MaxReseller does not provide support to our Reseller's Clients. Resellers are also responsible for all content stored or transmitted under their account.

Indemnification & Arbitration

Customer agrees to defend, indemnify and hold MaxReseller harmless from any and all demands, liabilities, and claims. Any disputes arising against MaxReseller will be handled by binding arbitration in the state of Tamil Nadu.

MaxReseller makes no warranties of any kind, expressed or implied for services we provide. We are not responsible for any damages your business may suffer.
